Rules on the mouvement of minors

On French territory (DOM, TOM, COM, and Mainland)
These procedures apply to leaving the territory of the mainland, including travel to the COM-DOM territories outside the Schengen Area.

MINORS OF FRENCH NATIONALITY

In possession of a passport:
Any minor, regardless of age, can obtain an individual passport with the permission of his legal representative. Possession of this document, provided it is valid, is sufficient to allow the minor to cross the border without any other document. If the minor is entered in the passport of another person, he must travel with the holder of this passport document.

In possession of a national identity card:
Whenever a minor visits a country in which the national identity card is sufficient to provide access, the following rules apply:

  • If the minor is accompanied by a person with parental responsibility, the minor may leave the territory under their currently valid national identity card, or a passport, even one that expired less than 5 years previously, for those countries which accept such expired documents.
  • If travelling alone or with a third party, the minor must also submit an authorisation to leave the territory drawn up by the office of the mayor of the minor's home town, using a specific form, or by the French consulate when the bearers of parental authority reside abroad.

NOTE: A handwritten document prepared by the parents shall under no circumstances be accepted as a substitute for an official document obtained from the aforementioned French administrative authorities.


FOREIGN MINORS ON THE TERRITORY

Any foreign minor who leaves the territory and who is entered onto the passport of his parents or who holds his own travel documentation must necessarily, in order to return to the territory, hold the following:

  • If born in France: of Republican identity document (TIR).
  • If born abroad: by a document for the circulation of foreign minors (DCEM).

Without these documents, the minor will be required to be in possession of a consular visa to enable him to return to the territory.

NOTE: The absence of a TIR or a DCEM and a visa will give rise to the establishment of a refusal of entry procedure and the enforcement of the fine provided for under Article L625-1 of the CESEDA against the air carrier having transported the minor.


BI-NATIONAL MINORS

Any person having dual nationality, French and foreign, must, within the national territory, have the right to have an only French law applied to him.

Therefore, if bi-national children, either singly or together with third parties who are not holders of the parental authority, upon leaving the country, present both a foreign passport and a French national identity card, this latter document must necessarily be accompanied by authorisation to leave the territory, also obtained either from a mayor's office or a French consulate abroad.
Authorisation to leave the territory is required if the escorting person is not one of the parents (father or mother), or if the child has a different surname.
In all cases, parents will have to prove paternity.
