1- Object
1.1 The PREFERENCE programme, managed by Air Caraïbes, is a loyalty program for air passengers, the purpose of which is to attribute to its members a credit of points, hereinafter referred to as miles, according to a predetermined scale and in accordance with the conditions and limitations set forth below, depending on the flights made by the member on Air Caraïbes.
1.2 Depending on the number of miles earned and accumulated by the member, the member can earn rewards on Air Caraïbes and/or with partners, according to a predetermined schedule and to the conditions and limitations set forth below.
2 - Participation in the "Preference" programme
2.1 Registration for the PREFERENCE programme is free. All individuals aged 12 and over whose usual address is in a country where the programme is applicable may participate
2.2 Legal entities may not participate in the programme. The employees and corporate officers of airlines, travel agents or Tour Operators and their legal beneficiaries are not entitled to join.
2.3 The signature of the legal guardian (or the trustee if that person is a minor) is mandatory for any minor wishing to join the PREFERENCE programme.
2.4 Any person applying for membership to this programme is presumed to have read and accepted these Terms and Conditions, which are also available on request from Air Caraïbes.
2.5 Only one membership per person is accepted.
2.6 Air Caraïbes reserves the right to refuse membership to any person who does not meet the criteria defined below.
2.7 Any person whose membership has been accepted by Air Caraïbes will have a personal account, an individual identification number and a PIN allowing access to various commercial and internet services. This identification number may be entered onto forms with a pre-numbered card or directly via the Internet site in the case of a registration via the Air Caraïbes website. This number should be given for any inquiries regarding the account.
2.8 Any change of address, name or other indication which may be necessary must be notified as soon as possible in writing to Air Caraïbes, who may request any supporting documents deemed necessary. Members guarantee the accuracy of all the information provided and will be solely responsible for any erroneous, incomplete or outdated information they provide.
2.9 Participation in the PREFERENCE programme takes effect as from the first use of the identification number on an air carriage service entitling the holder to Miles.
2.10 The definitive PREFERENCE card shall be issued and addressed to the Member at the end of the 5th flight with Air Caraibes or 10,000 miles, not including any bonuses, along with personal documentation about the PREFERENCE programme.
2.11 Any subscriber to an Air Caraïbes subscription is automatically a member of the PREFERENCE programme.
2.12 Registration in and acceptance of the PREFERENCE programme are mandatory before departure in order to qualify for any miles.
2.13 The flights operated on a code-sharing basis are not concerned by the programme.
2.14 Air Caraïbes reserves the right to change the rules, regulations, travel allowance and special offers at any time without notice and to end the programme after 3 months' notice. In the event that the programme is cancelled, no new Mile can be accumulated as from the date of cancellation communicated.
3 - Conditions of application and accumulation of Miles
3.1 The Mile is the unit of calculation for the PREFERENCE programme and corresponds to the English "statute mile", or 1609 m.
3.2 For each Member, a personal account is opened and credited with the Miles obtained.
3.3 For each flight paid in full, at a fare and between two points allowing the accumulation of Miles on the date of travel written on the ticket, the Member’s account is credited with a certain number of Miles; this number is determined by:
- the distance
- the minimum amount of Miles established for the distance between the departure point and the arrival point indicated on the ticket
- The flat rate of Miles stated in the PREFERENCE documentation.
The table of distances in miles can be obtained on request from Air Caraïbes or on the company's website. The schedule is also sent by the company, along with the loyalty card. The Miles credited to the member’s account are a function of the distance from the place of departure and the final destination of travel and the flight number. Miles are calculated per flight segment (flight segment = flight with no change of aircraft).
- the price corresponding to the booking class, fully paid for the entire journey, whatever the class in which the journey is actually made.
3.4 The flights and fares entitling members to Miles are determined by Air Caraïbes and may be changed without notice with immediate effect.
3.5 The miles will be credited to the Member’s account provided that he or she gave their identification number when booking and when issuing the ticket or when checking in for the flight.
3.6 The Miles will be credited to the Member’s account, regardless of the person who paid for the ticket.
3.7 In the event that the Member is also a member of another loyalty programme involving Air Caraïbes, the Member’s account cannot be credited for the same flight in the two programmes at once (unless otherwise communicated to the Member).
3.8 The use of the PREFERENCE card is reserved exclusively for its holder. The account and the miles obtained by the Member may in no circumstances be transferred, bequeathed, transferred or combined for free or for consideration to the account or to the miles of any other person, whether or not a participant in this programme (unless otherwise communicated to the Member). Miles cannot be converted into cash.
3.9 Under no circumstances can Miles be granted to a Member travelling on a free ticket (unless otherwise indicated). Furthermore, PREFERENCE bonus tickets do not entitle the Member to Miles.
3.10 The number of miles includes: accumulated base miles + bonuses and Business bonus miles.
3.11 Each Member shall personally ensure (via his statement, Internet, Customer Service etc.) that the Miles to which he is entitled have been credited to his account. Where the Member claims that he has obtained Miles which were not credited to his account, even though he had complied with the reporting procedures, he should send Air Caraïbes any proof (copy of ticket or "journey memo" for an electronic ticket, the boarding pass), within 6 months following the date of the flight or the service, up to 3 months before membership. Travel before these 3 months of retroactivity does not entitle the Member to the accumulation of miles. If his claim is justified, the Miles will be credited with retroactive effect 3.12 Tickets and coupons that are lost, unused, refunded or expired do not entitle Members to any credit of Miles.
3.13 Miles are not awarded to the member when reasons beyond the control of carriers (including cancellations due to strike action or internal or external security reasons) lead to the cancellation of flights by Airlines participating in the programme.
3.14 Air Caraïbes reserves the right at any time to require proof concerning the accumulation of Miles.
3.15 Air Caraïbes reserves the right to debit unduly credited Miles from the account of any Member.
3.16 Passengers must pay the taxes and duties relative to bonus tickets.
3.18 Miles obtained by the participant in the PREFERENCE programme are valid for 36 months from the end of the month in which a service giving rise to the Miles was performed. The Miles credited to the account of the Member expire monthly. When during this period there is activity on the account, the validity of 36 months applies as from the last recorded flight.
4- Level of participation
4.1 Two levels of participation are open to Members. To access the 2nd level, called "Gold", the member must accumulate in a period of 12 months preceding the month of qualification, a minimum number of "qualifying" Miles defined in the current schedule.
4.2 The number of "qualifying" Miles or travel necessary to qualify for the "Gold Preference" card may be amended at any time without notice.
4.3 The transition to a "Gold" level is valid for one year. If access to the "Gold" level is obtained, a new card is mailed to members of the programme. The "Gold" level of a member is lost if the number of qualifying Miles set in the current schedule is not achieved after one year.
4.4 The benefits of the "Gold" level are:
• extra bonus miles,
• Priority on waiting lists for booking and check-in,
• access to a priority check-in desk
• 10 kg of extra baggage,
• a priority label for the delivery of baggage,
• priority treatment in the event of an irregularity. Access to the company lounges (subject to availability)
5- Communication
A statement of account will be sent to all members for whom an operation was performed during the last two months (debit or credit). This statement will be sent by mail, fax or e-mail according to the choice made by the member when registering for the programme or his subsequent instructions to the Air Caraïbes management service.
A statement of account will be sent to all members at least once a year, including to those whose accounts have not had any operations during the past year.
The details of each Member can be used for marketing purposes for special offers, unless otherwise expressly indicated by the Member.
6 - Grant of bonuses - Account debiting
6.1 PREFERENCE bonuses consist of air tickets, upgrades, fixed excess baggage allowance of 10 kg, or any other benefit under the programme.
6.2 The list of bonuses and their conditions of validity, cancellation and, where applicable, modification are contained in the PREFERENCE documentation and/or are available from Air Caraïbes. The number of Miles required to obtain each bonus is available from Air Caraïbes.
6.3 Air Caraïbes reserves the right to modify the conditions for obtaining any bonus, including the number of Miles required, and to cancel any bonus offered without notice with immediate effect.
6.4 When a Member has accumulated a sufficient number of valid Miles for entitlement to a bonus, he may request this bonus in writing, by Internet and by telephone under certain conditions, specifying the beneficiary, in accordance with the bonus issuing procedures. The procedures for booking and requesting a bonus may be changed at any time by Air Caraïbes.
6.5 Only valid Miles registered on behalf of the member at the time of the request determine the status of his account. Any request including bonus miles arriving at expiry must be received by Air Caraïbes at least 30 days before the expiry date of these Miles, unless otherwise stated. The procedures for booking and applying for bonuses are indicated in the PREFERENCE documentation. The registration on a waiting list is not permitted.
6.6 Only the Member is entitled to request a bonus. If the Member is not legal capable of doing so (minor or major), the bonus request must be signed by the guardian or legal trustee.
6.7 As soon as the bonus application is processed, the member’s account is debited by the number of miles corresponding to the bonus, depending on the scale in force at the date of the request, the oldest Miles debited first.
6.8 Once the ticket or bonus certificate has been issued, certain changes are permitted if it is an Air Caraïbes flight (TX code), within the limits of the validity of the ticket. These changes have to be paid for unless specifically stated otherwise in the PREFERENCE documentation. The amendment procedures are communicated to Members. Once the ticket issued, no change of beneficiary and/or destination will be allowed (unless otherwise indicated). Any cancellation of the flight by the member immediately leads to a new booking and the payment of the costs for such a cancellation (unless specific conditions state otherwise). The validity of bonus tickets is 12 months from the date the bonus is issued.
6.10 The issue of bonuses is subject to the regulations of the PREFERENCE programme. It is up to each Member to seek information on the rules of the programme in order to know their rights and responsibilities. The bonus certificates or bonus tickets, once issued, are non-transferable and indivisible, and bonuses or bonus certificates can never be awarded retroactively, have a refund or exchange value, be refunded or exchanged, be transferred, sold or cashed in any form whatsoever, be replaced if lost, stolen, destroyed or only partially used.
6.11 The beneficiary of the bonus is solely responsible for the payment of all taxes or duties applicable to the bonuses granted under the programme, as well the communication of the receipt of such bonuses to the government authorities concerned. In this regard, the member must pay all airport and security fees and taxes, irrespective of the recipient of the bonus.
6.12 Partially unused bonuses are not refundable. In case of prior cancellation, bonuses may be modified under the conditions specified in the PREFERENCE documentation.
6.13 The member is solely responsible for the use of bonuses, whether used by him or by a third party.
6.14 In the event that a bonus is improperly denied to the member, the liability of Air Caraïbes shall be limited to the value of this bonus. Compensation may only be made in the form of a bonus of equivalent value.
BONUS TICKETS
• An airline ticket bonus is called a "bonus ticket".
• The bonus tickets are issued in the name of the Member and/or in the name of any other person designated by the Member at the moment the bonus ticket is requested.
• A beneficiary entitled to a special discount (baby, child, student, elderly person, etc.) will not benefit from a reduction in the number of Miles required for the granting of a bonus ticket.
• The Member has access to bonuses on Air Caraïbes under the terms set forth in the PREFERENCE documentation.
• Access to these bonuses depends on the number of seats reserved for the PREFERENCE programme. Air Caraïbes is the sole judge of the number of seats available. No claims from passengers will be accepted, even in the case of a flight that is not full.
• The request for a bonus ticket can be made:
- in an AIR CARAIBES agency: upon presentation of the PREFERENCE card (or a copy), the member’s identity card (or a copy) and the original of the bonus application signed by the member authorising the withdrawal.
- by phone, fax or e-mail: copies of the identity card and bonus application signed by the member authorising the withdrawal are sent later.
This procedure may be modified or suspended at any time by Air Caraïbes. A ticket cannot be used for transport on a stretcher, for a baby seat, for the accompaniment of a child by a hostess or the beneficiary of an extra seat.
• Bonus ticket on designated flights. The bonuses are valid up to the limit of available seats.
• Waiting lists are not permitted for bonus tickets.
UPGRADE
• The upgrade bonus means the opportunity to travel in a class higher than that duly paid for on Air Caraïbes flights, under the conditions and fares set forth in the PREFERENCE documentation.
• Upgrades apply upon submission of a fully paid airline ticket (individual public fare, unless otherwise indicated).
• Bookings are made within the limits of available seats and in a specific booking class where seating is limited; it is possible a maximum of 15 days before departure and until the day before departure (2 days for departures from Paris).
• The upgrade application can be made:
- in an AIR CARAIBES agency: upon presentation of the PREFERENCE card (or a copy), the member’s identity card (or a copy) and the original of the bonus application signed by the member authorising the withdrawal.
- by phone, fax or e-mail: copies of the identity card and bonus application signed by the member authorising the withdrawal are sent later.
EXCESS BAGGAGE
• The transport of 10 kilos of excess baggage is in addition to the amount authorised in class paid for, and for one-way journeys, in accordance with the current schedule.
• Air Caraibes can accept a maximum of thirty kilograms (30kg) of excess baggage per flight per member or beneficiary family member.
• The baggage excess application can be made:
- in an AIR CARAIBES agency: upon presentation of the PREFERENCE card (or a copy), the member’s identity card (or a copy) and the original of the bonus application signed by the member authorising the withdrawal.
- by phone, fax or e-mail: copies of the identity card and bonus application signed by the member authorising the withdrawal are sent later.
7- Miscellaneous
7.1 Air Caraïbes may expand its PREFERENCE programme to include other partners. Air Caraïbes will inform members of the integration and the conditions of these new partnerships.
7.2 Any Member may notify any third party or any person paying credited airfares or services about the Miles and advantages obtained with the PREFERENCE programme.
7.3 Any Member noting the loss and/or theft of the PREFERENCE card shall immediately notify Air Caraïbes in writing. Air Caraïbes assumes no liability for any fraudulent use of the Card.
7.4 Air Caraïbes reserves the right to exclude any member of the PREFERENCE programme who:
- makes improper use of the benefits awarded under the programme
- has made false statements,
- uses Air Caraïbes tickets for fraudulent purposes,
- does not accumulate Miles for 36 consecutive months,
- or who fails to comply with these terms and conditions and/or the General Terms and Conditions of Carriage in force. A person once excluded may be refused membership later.
On the death of a member, Air Caraïbes closes the account. In the event of exclusion and/or account closure, all the rights attached to previously accumulated miles are lost, without the Member or any third party / claimant being able to claim any compensation. The card must be returned.
7.5 The laws of some countries may impose restrictions on the conditions for the application and/or participation in the PREFERENCE programme. To comply with these laws, Air Caraïbes will be entitled to immediately apply the new legal instructions and to modify its programme accordingly without notice.
7.8 Air Caraïbes reserves the right to modify the programme (rules, conditions for participation, total or partial value of Miles acquired at any given time, period of validity of the Miles, procedures for obtaining bonuses, bonus schedules) at any time, without notice, in compliance with the legislation in force.
7.6 Airline bonuses are subject to the Terms and Conditions of Carriage in force. Air Caraïbes assumes no liability for damage caused when using a bonus, excluding damage during carriage for which the carrier’s liability is governed by the Warsaw Convention or by the laws of France in the case of domestic transport.
7.7 The Member will be liable for any claims by any third party (including tax authorities) related to his participation in the PREFERENCE programme.
7.10 The Member is entitled to cease to participate in the PREFERENCE programme. In such an instance, he will notify Air Caraïbes in writing and return his card. Miles accumulated or transferred will be lost.
7.11 The data on the credit and debit of miles are kept for 1 year. Under the Act of 6 January 1978, members have a right to access and modify personal information.
7.12 In case of disagreement on the interpretation of the General Conditions of the programme and of all documentation, only French law is applicable for the performance of the contract.
